Terms of Service

These Terms govern your access to and use of VibeCheck, a text-message based service that accepts a face photo, searches for possible public web matches, sends preview cards, and lets you pay to unlock source links. By texting VibeCheck, sending a photo, tapping or replying to unlock a result, opening a checkout link, or otherwise using the service, you agree to these Terms.

1. What VibeCheck Does

VibeCheck uses automated tools and third-party service providers to compare a submitted face photo against publicly available web results. Results are probabilistic and may be incomplete, stale, incorrect, duplicated, or associated with someone other than the person in the photo. VibeCheck is not an identity verification, background check, employment screening, credit, insurance, housing, law enforcement, or safety decision tool. VibeCheck is not a consumer reporting agency and does not provide consumer reports.

Preview cards obscure source links. If you choose to unlock a result, VibeCheck creates a payment checkout and, after payment confirmation and source-link checks, sends the unlocked link by message.

2. Eligibility and Your Responsibilities

You must be at least 18 years old and legally able to enter into these Terms. You are responsible for the photos, messages, replies, reactions, and other content you submit, and for making sure your use of VibeCheck complies with all laws that apply to you.

You represent that you have all rights, permissions, and lawful bases needed to submit each photo and to use the results. Do not submit photos of minors, private or intimate images, images obtained without authorization, or images you are not legally allowed to process.

3. Prohibited Uses

You may not use VibeCheck to:

• harass, stalk, threaten, intimidate, dox, exploit, or endanger anyone;
• identify, locate, monitor, or profile a person without a lawful and appropriate basis;
• make decisions about employment, housing, credit, insurance, education, benefits, law enforcement, or eligibility;
• make claims or decisions about a person's character, integrity, reputation, criminal history, or legal status;
• search for or process photos of children or minors;
• violate privacy, publicity, intellectual property, consumer protection, anti-discrimination, or other rights;
• submit illegal, abusive, deceptive, non-consensual, sexual, or exploitative content;
• scrape, reverse engineer, overload, interfere with, or attempt to bypass limitations in the service; or
• use VibeCheck in any way that could expose us, our users, or our providers to legal, safety, or security risk.

We may block users, refuse searches, withhold results, suspend access, or report activity when we believe a use is unsafe, unlawful, abusive, or inconsistent with these Terms.

4. Face Photos and Sensitive Data

Face photos and related search data may be considered biometric information, sensitive personal information, or otherwise regulated data under some laws. By submitting a photo, you authorize VibeCheck and its service providers to process the photo and related data to provide, secure, troubleshoot, and enforce the service. Our Privacy Policy explains our data practices. VibeCheck is not designed for HIPAA, GLBA, FCRA, or other regulated workflows, and you may not use it where those laws would require a specialized regulated service.

5. Payments, Weekly Plan, Cancellations, and Refunds

Payments are processed through Whop or another checkout provider shown at checkout. You agree to the price, billing interval, and checkout terms presented before payment. A single-result unlock is currently $9.99. VibeCheck Weekly is currently $19.99 per week and unlocks all links for the current search plus up to 20 more searches during each rolling 7-day period while active.

Weekly plans renew until canceled. You are responsible for canceling before the next renewal through the checkout provider's account, billing, or receipt flow, or by contacting us at support@vibecheck.fast. Canceling stops future renewals but does not automatically refund past charges.

Except where required by law, purchases are final once an unlock is fulfilled. We may issue a full or partial refund when a paid source link is unavailable, fulfillment fails, a duplicate charge occurs, or we otherwise determine a refund is appropriate. Chargebacks and disputes may be handled by the payment provider.

6. Messaging

VibeCheck operates through iMessage, SMS, MMS, and related messaging infrastructure. By texting VibeCheck, you consent to receive transactional messages related to searches, previews, payment links, unlocks, support, and service administration. Message and data rates may apply. Reply STOP to opt out. Reply HELP for basic instructions. Reply DELETE to request deletion of stored search images and result previews tied to your phone number where feasible.

7. Third-Party Services and Public Web Results

VibeCheck relies on third-party providers for messaging, face search, payments, hosting, storage, rendering, analytics, logging, and administration. We are not responsible for third-party websites, public web sources, payment providers, carrier behavior, or messaging platform delays or failures. Unlocked links may point to third-party sites governed by their own terms and policies. VibeCheck does not control the public web pages, search-provider indexes, or third-party databases where possible matches may originate.

8. No Guarantees

VibeCheck is provided "as is" and "as available." We do not guarantee that searches will succeed, that results will be accurate or complete, that any person will be identified correctly, that any link will remain available, or that the service will be uninterrupted or error-free. We do not make any representation about the character, integrity, criminal history, legality, safety, or trustworthiness of any person shown in or associated with search results.

9. Your Content and License

You keep whatever rights you have in content you submit. You grant VibeCheck a limited license to host, process, transmit, transform, display, and use submitted content as needed to provide, secure, improve, troubleshoot, and enforce the service and comply with law.

10. Indemnity

You will defend, indemnify, and hold harmless VibeCheck and its operators, affiliates, service providers, and personnel from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your content, your use of the service, your violation of these Terms, or your violation of law or another person's rights.

11. Limitation of Liability

To the fullest extent permitted by law, VibeCheck will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, reputational harm, or third-party conduct. To the fullest extent permitted by law, VibeCheck's total liability for all claims relating to the service will not exceed the greater of $100 or the amount you paid to VibeCheck in the 3 months before the event giving rise to the claim.

12. Changes and Termination

We may change, suspend, or discontinue any part of the service at any time. We may update these Terms by posting a revised version. Your continued use after the effective date of updated Terms means you accept the updated Terms.
